Terms of Service

Effective Date: October 27, 2026 · Last Updated: October 27, 2026

These Terms apply once they are posted and you accept them. Questions? contact@sherisesstudios.com

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of The Author Takeover Engine™ (the “Engine”). The Engine is operated by FENIX TV LLC, a California limited liability company (“FENIX TV,” “we,” “us” or “our”), which is the party you contract with. She Rises Studios LLC (“She Rises Studios”) owns the Engine’s technology and intellectual property and licenses it to FENIX TV.

By creating an account, checking a box or clicking to accept, or using the Engine, you agree to these Terms. If you use the Engine on behalf of a business or other organization, you confirm that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Engine.

2. Eligibility and International Availability

You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Engine.

We offer the Engine in other countries only where it is lawful and where we choose to support it. Nothing in these Terms limits consumer protection rights that cannot be waived under the laws where you live.

3. The Services

The Engine helps authors plan and manage book marketing. Depending on your access, features may include:

  • Author profiles and book information;
  • Marketing campaigns and tasks;
  • Opportunity research and matching;
  • AI-assisted drafting;
  • Media pitches with review and approval steps;
  • Sending email from an account you authorize;
  • Replies you record manually;
  • File uploads and data exports.

Some features are offered as beta or pilot features. They may be limited, change, use sample or simulated information, or be removed. We do not promise features that are not currently provided to your account.

4. Your Account

You agree to provide accurate information, keep it up to date, and keep your sign-in details secure. You are responsible for activity in your account.

You may not share your account, impersonate anyone, or try to bypass sign-in, access limits or approval steps. Administrator roles are protected and are granted only by us.

5. Your Author Content

You own your original manuscripts, books and other content you upload or create (“Author Content”). These Terms do not transfer ownership of your Author Content to us.

You give FENIX TV and She Rises Studios a limited, nonexclusive license to host, store, process, display and transmit your Author Content only as needed to provide, secure and support the Engine for you. We will not independently publish or promote your Author Content without your permission.

You confirm that you have the rights needed to upload and use your Author Content. This license ends when your Author Content is deleted, subject to retention described in Section 17 and our Privacy Policy.

6. Engine Intellectual Property

She Rises Studios owns the Engine’s original software, interfaces, designs, workflows, branding, templates and other protectable intellectual property, subject to the rights of third parties and open-source licensors.

We give you a limited, nonexclusive, nontransferable, revocable license to access and use the Engine for its intended purpose while you follow these Terms. You may not copy, scrape, reverse engineer, resell, or circumvent security of the Engine, or misappropriate its intellectual property, except where such conduct is expressly protected by applicable law.

7. AI-Assisted Features

You may use AI-generated output from the Engine, subject to the rights of third parties. You are responsible for reviewing and verifying output before you use it.

We do not guarantee that output is accurate, original or eligible for copyright protection.

We do not intentionally use your Author Content to train AI models unless you give separate, explicit opt-in consent. The training and data controls of our AI providers have not yet been independently verified, and we are working to validate them.

8. Research and Opportunities

The Engine may suggest potential opportunities such as media outlets, podcasts, speaking events, bookstores, libraries and similar venues. Information may come from third-party sources or simulated samples and may be incomplete, outdated or inaccurate.

We do not guarantee that any opportunity is available, that you are eligible, or that anyone will respond. You are responsible for verifying source details before relying on them.

9. Gmail and Connected Email

During our limited pilot, you may choose to connect a Gmail account. The Engine requests only your email address (userinfo.email), to identify the account, and permission to send email (gmail.send). Each message is sent only after you individually and explicitly approve it.

The Engine does not read your inbox. Replies are recorded manually by you. You are responsible for lawful outreach and for honoring opt-out requests. We do not guarantee delivery of any message. Email connection is a pilot feature and may not be available to all accounts.

10. Subscriptions and Payments

Paid subscriptions and checkout are not currently active, and prices shown are for information only. When subscriptions become available, FENIX TV LLC will be the merchant of record, and you may choose to pay through Stripe or PayPal where supported.

Plans may be offered monthly or annually. Prices are in U.S. dollars unless otherwise stated. Applicable taxes and any currency conversion will be disclosed at checkout.

11. Automatic Renewal

If you purchase a subscription, it will renew automatically each month or year, depending on your plan, unless you cancel. Before you purchase, we will clearly show the renewal terms, price and how to cancel, and ask for your consent. We will send renewal reminders and other notices where required by law.

12. Cancellation

You may cancel a subscription at any time. Cancellation stops future renewals immediately. Your paid access continues until the end of the term you already paid for. Cancelling a subscription does not delete your account; account deletion is a separate request.

13. Refunds

Payments are generally nonrefundable, except where a refund is required by law, where you have statutory rights, or to correct a billing error.

14. Price and Plan Changes

We may change prices or plan features. We will give advance notice of price changes and obtain your consent where required by law. Changes apply from your next renewal unless otherwise stated.

15. Usage Limits and Service Availability

Plans and pilot programs may include allowances for AI requests, research, storage and outreach. We may pause features when an allowance or a safety limit is reached.

We work to keep the Engine available, but we do not guarantee any particular uptime, and the Engine may be unavailable for maintenance or other reasons.

16. Uploads and Files

Upload only files you have the right to use. Do not upload malware or harmful files. File size and type limits may apply. Uploads are not currently scanned for malware, so please keep your own security protections in place.

17. Data Exports and Deletion

Where available, you may export eligible account data. We recommend keeping your own copies of important content.

You may request deletion of your account. Deletion is subject to information we must keep by law, data that remains in backups for a period, and copies that exist outside the Engine, such as emails already sent. Deleted content may not be recoverable, and we do not guarantee restoration.

18. Acceptable Use

You may not use the Engine to:

  • Send spam or unwanted bulk messages;
  • Harass, threaten or abuse anyone;
  • Commit fraud or mislead others;
  • Infringe intellectual property or other rights;
  • Scrape or collect data without authorization;
  • Reverse engineer the Engine, except as permitted by law;
  • Misuse, share or steal credentials;
  • Upload or spread malware;
  • Post false reviews or claim false outcomes, endorsements or achievements.

19. Suspension and Termination

We may suspend or terminate access for security risks, illegal activity, serious or repeated violations of these Terms, fraud, or nonpayment. Where practicable, we will give fair notice and an opportunity to retrieve your content, where permitted by law and safe to do so. You may stop using the Engine at any time.

20. No Guaranteed Outcomes

We do not guarantee media placements, sales, speaking engagements, endorsements, rankings, profitability, partnerships or any other results.

21. Warranties

To the extent permitted by law, the Engine is provided on an “as available” basis. Nothing in these Terms limits warranties or rights that cannot be excluded under applicable law.

22. Limitation of Liability

To the extent permitted by law, FENIX TV is not liable for indirect, incidental, special or consequential damages, such as lost profits or lost data, arising from your use of the Engine. Nothing in these Terms limits liability that cannot be limited under applicable law.

23. Indemnification

To the extent permitted by law, you agree to be responsible for claims and losses caused by your intentional misuse of the Engine or your infringement of others’ rights.

24. Third-Party Services

The Engine relies on third-party services, including hosting, authentication, AI, research, email, analytics, and payment providers such as Stripe and PayPal. Your use of those services may be subject to their own terms and policies.

25. Changes to These Terms

We may update these Terms. We will post the updated version and change the “Last Updated” date. For material changes, we will provide notice and obtain your consent where required by law.

26. Disputes and Governing Law

If you have a concern, please contact us first at contact@sherisesstudios.com so we can try to resolve it informally. If we cannot resolve it, either party may bring the dispute in a court with appropriate jurisdiction.

These Terms are governed by the laws of the State of California, without limiting consumer protection rights that cannot be waived under the laws where you live.

27. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and FENIX TV about the Engine, except where you have a separate written agreement with us.
